Agreement to Terms

By accessing or using TripAware (“the Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree with any part of these Terms, you should not use the Service. These Terms constitute a legally binding agreement between you and TripAware.

Description of Service

TripAware is a weather-optimized travel discovery platform that helps users find destinations based on climate preferences, activity interests, and travel timing. The Service includes destination matching and scoring based on historical weather data, climate profiles and weather statistics for destinations, flight search powered by third-party airline data, and outbound links to third-party booking platforms.

TripAware is an informational and planning tool. We are not a travel agency, tour operator, or booking platform. We do not sell flights, hotels, or travel packages directly.

Eligibility

You must be at least 16 years of age (or the age of digital consent in your jurisdiction) to use TripAware. By using the Service, you represent that you meet this requirement.

Climate Data and Weather Information

TripAware provides climate intelligence based on historical weather data spanning approximately 10 years of records. This data reflects historical averages and patterns, not forecasts or guarantees of future weather conditions.

You acknowledge and agree that:

  • Climate data represents historical averages and is not a weather forecast.
  • Actual weather conditions at any destination may differ significantly from historical patterns.
  • Match scores and climate ratings are algorithmically generated and reflect relative fitness against stated preferences, not absolute guarantees of trip quality.
  • Weather data may contain gaps, inaccuracies, or limitations for certain destinations or time periods.
  • TripAware should not be used as the sole basis for making travel decisions, particularly where safety may be affected by weather conditions (e.g., hurricane-prone regions, extreme heat areas).

Flight Search and Booking

The flight search feature displays real-time pricing retrieved from third-party airline data providers (currently Duffel). When you click booking links, you are redirected to third-party platforms (such as Google Flights, Kayak, or airline websites) to complete your purchase.

You acknowledge and agree that:

  • TripAware is not a party to any booking transaction. All purchases are between you and the airline or booking platform.
  • Flight prices displayed are indicative and may change between the time of search and the time of booking.
  • TripAware does not guarantee the accuracy, availability, or completeness of flight pricing data.
  • All booking terms, cancellation policies, and customer service are governed by the third-party provider through which you book.
  • TripAware is not responsible for any issues arising from bookings made through third-party platforms.

Third-Party Links and Services

TripAware contains links to third-party websites and services, including booking platforms, airline websites, and accommodation providers. These links are provided for your convenience. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party sites. Your interactions with third-party services are governed by their respective terms and policies.

Intellectual Property

All content on TripAware, including but not limited to text, editorial descriptions, scoring algorithms, design, graphics, user interface, and software code, is the property of TripAware or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Destination images are sourced from Unsplash under the Unsplash License. Climate data is sourced from Open-Meteo.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from TripAware without our prior written permission, except for personal, non-commercial use of the Service as intended.

Acceptable Use

When using TripAware, you agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Scrape, crawl, or use automated tools to extract data from TripAware without our prior written consent.
  • Attempt to gain unauthorized access to any part of the Service, its servers, or databases.
  • Interfere with or disrupt the Service or impose an unreasonable load on our infrastructure.
  • Use the Service to transmit malware, spam, or other harmful content.
  • Impersonate TripAware, its operators, or any other person or entity.
  • Reproduce, resell, or redistribute TripAware’s content, data, or services for commercial purposes.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any climate data, match scores, flight prices, or other information provided through the Service.

Nothing in these Terms excludes or limits warranties that cannot be excluded or limited under applicable law. If you are a consumer in the European Union, you retain all rights guaranteed by mandatory consumer protection laws in your country of residence.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIPAWARE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

This includes, without limitation, damages arising from reliance on climate data or match scores when making travel decisions, issues with bookings made through third-party platforms linked from TripAware, inaccurate or incomplete flight pricing information, and service interruptions or data loss.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

Indemnification

You agree to indemnify and hold harmless TripAware and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another party. This indemnification obligation does not apply to EEA or UK consumers to the extent prohibited by mandatory local law.

Modifications to the Service

We reserve the right to modify, suspend, or discontinue any aspect of TripAware at any time, with or without notice. We may add, remove, or change features, destinations, or functionality. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on this page with an updated “Last updated” date. By continuing to use TripAware after revisions become effective, you agree to be bound by the updated Terms. For material changes, we will provide reasonable notice (such as a banner on the homepage).

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.

If you are a consumer in the European Union, you also benefit from any mandatory provisions of the law of your country of residence and may bring proceedings in the courts of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on mandatory local law.

EU residents may also use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TripAware regarding your use of the Service and supersede any prior agreements.
